These Terms of Service ("Terms") govern your use of the done-for-you outbound lead generation services provided by PulseForce ("we," "us," "our"). By purchasing our services, you ("Client," "you") agree to these Terms.

Services

PulseForce provides done-for-you outbound lead generation for SEO agencies targeting home service businesses. Our service includes:

  • Ideal customer profile (ICP) mapping and target audience definition
  • Prospect list building using verified business contact data
  • Email sequence copywriting (including A/B variants)
  • Email infrastructure setup including warmed sending domains and inboxes
  • Sequence launch and ongoing management via Instantly
  • Reply handling and booking link delivery
  • Cal.com calendar integration for direct booking
  • Weekly performance reporting

What is not included. PulseForce is responsible for delivering booked calls to your calendar. Converting those calls into paying clients is the Client's sole responsibility. We are not a sales training service and do not guarantee revenue or closed deals.

Pricing and Payment

Setup Fee. A one-time setup fee of $2,500 is due at the time of purchase. This covers ICP mapping, prospect list build, copywriting, email infrastructure setup, and campaign launch.

Monthly Retainer. A recurring fee of $1,500 per month covers ongoing campaign management as described in the Services section above. Your first monthly payment is collected at or shortly after setup. Subsequent payments are billed automatically on the same date each month via Stripe.

Failed Payments. If a monthly payment fails, we will attempt to process it again within 3 business days. If payment cannot be collected after two attempts, campaign operations may be paused until the balance is resolved.

Refund Policy on Setup Fee. The setup fee is non-refundable once onboarding has begun (i.e., once we have completed an intake call or begun list building). If you cancel before any onboarding work has started, we will issue a full refund upon request.

Monthly fees are non-refundable for the current billing period. If you cancel mid-month, campaign operations continue through the end of the paid period.

No Guarantee of Results

PulseForce targets 15–30 booked calls per month as a service benchmark, not a contractual guarantee. Actual results vary based on factors including your offer, your market, your ICP definition, the quality of your sales process, and market conditions outside our control.

We do not guarantee a minimum number of booked calls, closed deals, or revenue generated from our service. Our commitment is to build and operate a high-quality outbound system on your behalf using industry best practices.

Client Responsibilities

To receive full value from our service, you agree to:

  • Provide accurate ICP information during onboarding, including target niches, geography, and business size
  • Connect a valid Cal.com calendar and keep it up to date with your availability
  • Respond to booked calls and show up to scheduled meetings
  • Notify us promptly if your offer, target market, or availability changes materially
  • Not conduct separate outbound campaigns to the same prospect lists during an active engagement without our knowledge, as this can damage deliverability

We are not responsible for underperformance caused by inaccurate ICP information, unconfigured calendars, or failure to attend booked calls.

Intellectual Property

Campaign deliverables. Upon full payment of all outstanding balances, you own the prospect lists, performance data, and final sequence copy created specifically for your campaign. You may use these materials after the engagement ends.

PulseForce systems and templates. The underlying outreach frameworks, sequence templates, prompt structures, and technical infrastructure used to deliver the service remain the intellectual property of PulseForce. These are not transferred to the Client.

Your brand assets. You retain ownership of all brand materials, agency information, and offer details you provide to us. You represent that you have the right to use all materials you provide.

Exclusivity and Roster Limits

To protect prospect list quality and email deliverability, we limit the number of active clients we serve at one time. We reserve the right to decline or defer new engagements based on current capacity.

We do not offer geographic or niche exclusivity unless explicitly agreed to in a separate written addendum.

Cancellation

You may cancel your monthly retainer at any time with 30 days written notice via email to jarod@pulseforce.ai. Upon cancellation:

  • Campaign operations will continue through the end of the current paid billing period.
  • We will deliver a final export of your prospect lists, sequence copy, and performance data within 30 days of your last billing date upon request.
  • Access to shared campaign tooling (Instantly inboxes, sequences) will be revoked at the end of the final billing period.

We reserve the right to cancel your service with 30 days notice if your account has an outstanding balance for more than 60 days, or if you are found to be in violation of these Terms.

Acceptable Use

You agree that the outbound campaigns we run on your behalf will not be used to:

  • Market illegal products or services
  • Send spam or misleading communications in violation of CAN-SPAM, GDPR, or other applicable laws
  • Harass or contact individuals who have opted out
  • Impersonate another business, individual, or brand
  • Engage in any activity that violates applicable federal, state, or local law

We reserve the right to pause or terminate your campaign immediately if we determine that the service is being used in violation of these terms or applicable law.

Confidentiality

Both parties agree to keep confidential any non-public information shared during the engagement, including but not limited to your offer details, ICP criteria, campaign performance data, and pricing. Neither party will disclose the other's confidential information to third parties without prior written consent, except as required by law.

Limitation of Liability

PulseForce provides outbound lead generation services on a best-efforts basis. We are not liable for:

  • Lost revenue or business opportunities resulting from prospect no-shows, unqualified leads, or failed sales calls
  • Changes in email deliverability due to factors outside our control (provider policy changes, domain blacklisting from causes unrelated to our campaigns)
  • Third-party service outages affecting Apollo, Instantly, n8n, Cal.com, or Stripe
  • Inaccurate prospect data sourced from third-party data providers

Our total liability for any claim arising from these services is limited to the total amount you have paid to PulseForce in the 3 months preceding the claim.

Modifications to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email at least 30 days before the changes take effect. Continued use of our services after the effective date constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Indiana. Any disputes arising from these Terms will be resolved in the courts of Decatur County, Indiana.
